<p>My husband bought a parcel of land in Pampanga. The mother title specifies the entire 8 hectares of land (matured year 2009). We only bought 2 hectares from it. How can we go about created a DOAS of the technical decription refers to the entire 8 hectares? After the DOA, how can we have our own title. You help is greatly sppreciated. Thanks so much.</p>
<p>Answer:</p>
<p>The owner or seller should have the entire 8 HA surveyed and subdivided already before selling you the the 2 HA.. Since they have not done so, you will have to do it yourself at great costs by going to DENR and request relocation survey to establish the boundaries of your 2 HA. With all the technical description, you could now go to the Register of Deeds for your individual DOAS.</p>

<p>You have to pay the interest equivalent to 2% per month on the basic tax, but in no case shall exceed 36 months.</p>

<p>I transferred my mortgage from inhouse to bank, my question is…how long is it to process the transfer of title from my developer to my name? Am having an idea that my developer is taking it too long to process to enjoy their high interest rate. thank you in advance.</p>
<p>Answer:</p>
<p>It really takes sometime to transfer the title from the developer to your name. The developer will do it in bulk to arrange for transfer of titles of several properties. The reason is minimize expenses and save time. You have to do it yourself to fast track the process.</p>

<p>Hi! I am planning to apply for a housing loan at Pag-ibig. Upon securing a certified true copy of my property (as one of the requirements) at the Register of Deeds sometime July, 2011, I found out that there was an annotation of an adverse claim of one of my siblings. Adverse claim was filed 2004 yet and did not receive a copy of that claim.No case was filed in court. Just want to clear it up if there’s an expiration for this adverse claim.Please advise. Thank you!</p>
<p>Answer:</p>
<p>The annotation will be in the TCT forever .You have to check with RD on the proper steps to take in order that the annotation could be removed.</p>

<p>Answer:</p>
<p>As most foreclosed properties are sold on an &#8220;as is where is basis&#8221;, the answer is yes. Unless you have a previous arrangement with the company you bought it from. If none, then expect to pay the previous owner&#8217;s taxes.</p>

<p><a href="http://houses.forsalephilippines.com/guides/checklist-of-documentary-requirements-cdr-donors-tax-philippines/">Donation of the property</a> executed by your father will be more practical  since the tax is lower than sales tax by deed of sale. You could also  inherit the property if your parents are both deceased but you have to pay  estate tax.</p>

<p>We bought a lot with a depreciated house 3                 months ago and we immediately proceed with the                 improvements. We want to process the transfer of title                 now. What should be the value that we are going to                 declare with assessors office since the property has                 already improvements. We bought the house and lot at                 Php325,000.00, we spent 500k in the improvements.</p>
<p>Can you also provide an estimate how much                 we are going to spend with the transfer of title..</p>
<p><strong>Answer:</strong></p>
<p>Declare it at Peso 825.000.00 which is the market value. The Real Estate Property Tax = Peso 825,000.00 X 20% X 2% = Peso 3,300.00.</p>
<p>To transfer the title under your name: you have to pay the documentary stamp tax of 1.5% + transfer tax ( Peso 825,000.00 or<br />
market value declared by BIR X 1% X 75% ) + registration fee + assessor office&#8217;s fee ( about Peso 250.00 ).</p>

<p>You could arrange easily with the developer before they process the  transfer. If done, then you could still transfer under your name by deed  of donation executed by your parents. You have pay a donor&#8217;s fee.</p>

<p>We           purchase a town house 6yrs ago under pag-ibig financing we           paid it in full last Jan. Pag-ibig advice us to get the title           from them next week. However, the developer told me to give           them the original title and taxes paid bec they still need to           transfer the name to us and for taxes purpose. They say           Pag-ibig no longer want to give them the title bec we are           already fully paid.Is this correct that I should give them the           title? its quite confusing.</p>

<p><strong>Answer:</strong></p>
<p>The title should be in your name already but in the file/possession of  Pagibig because it&#8217;s mortgaged to Pagibig. Once it&#8217;s fully paid, you get  the original title from Pagibig, bring it to The Registry Of Deeds and  request them to remove the mortgage statement at the back of the title.</p>
